    What is CoolSculpting?

Cool Sculpting is the brand name for a fat-freezing method designed to get rid of stubborn fat in specific parts of the body. The method is called cryolipolysis and was approved by the FDA in 2010. This method is not surgical and does not use any needles. During the procedure, the device is placed on the target area, and the cooling will begin. The device will be left on for 35 minutes or more. During this time, the process is destroying fat cells in the area. After the procedure, the immune system removed the dead fat cells over time. Although results can be noticed within just two weeks, final results can take a few months to show.

The Risk Factors Associated with CoolSculpting

CoolSculping, in general, is associated with little to no risks. The procedure is done in-office, and there is often no need to for recovery time after. In fact, patients can drive themselves home after the procedure. During the process, there could be pulling/tugging sensations on the skin as well as an intense cold feeling. After the procedure, there could be minor swelling. In addition, some patients experience soreness in the treated area, similar to soreness from exercising. Although rare, the procedure can potentially result in mild to moderate pain or even nerve pain.

One of the major complications of this procedure, although it occurs in less than 1% of patients, is paradoxical hyperplasia (PH) or paradoxical adipose hyperplasia (PAH). PAH occurs when the number of fat cells actually increase instead of decrease during the treatment. It can cause large, firm masses under the skin in the area that was treated. In other words, PAH causes new growth of fat cells and other tissue in the area that was treated; these growths can present themselves as hard knots, bulges, masses, and bumps under the skin. These are disfiguring and can be permanent. PAH can require liposuction and other surgical procedures to correct.

A Famous Case of PAH Caused by CoolSculpting – Linda Evangelista Settles a $50 Million Lawsuit

In the summer of 2022, supermodel Linda Evangelista made a social media post saying that she is ready to return to the catwalk after finally setting her lawsuit against CoolSculpting’s parent company, Zeltiq Aesthetics Inc, alleging that she was unable to work since her procedures. The supermodel had a total of seven CoolSculpting sessions in 2015 and 2016 to target her thighs, bra area, and chin. Instead of seeing positive results, she was left deformed – with hard, numb bulges over her body. She was ultimately diagnosed with PAH. She had to undergo two corrective surgeries which were ultimately unsuccessful. Allegedly, Evangelista was never made aware of the risk of developing PAH due to the procedure.

    Can I File a Lawsuit?

If you were diagnosed with paradoxical adipose hyperplasia (PAH) or paradoxical hyperplasia (PH) after undergoing CoolSculpting, you could have the right to file a lawsuit – especially if you were not informed of the risk before the procedure. For more information about your right to file a lawsuit after you were diagnosed with paradoxical adipose hyperplasia (PAH) or paradoxical hyperplasia (PH), contact the experts here at our law firm as soon as possible. Our team is more than ready to help you every step of the way.

    Can I Recover Compensation?

Yes – you could be eligible to recover compensation for your CoolSculpting lawsuit. Based on the details surrounding your claim, you could be entitled to recover compensation for some of the following:

    • Medical costs
    • Lost earnings or lost pay
    • Pain and suffering
    • Punitive damages
    • Legal fees

What is the average value of CoolSculpting lawsuits? There are many facts that must be evaluated to determine the possible value of a lawsuit, including the type of harm suffered, whether the harm was permanent, how long the victim was unable to work, and the victim’s earning history, for instance. In general, these cases can be worth anywhere from $300,000 to $1.5 million. In the $50 million settlement example above, such a high settlement was possible likely only because the victim was a supermodel. The average person, however, will not have lost millions in income, for instance.

How long do I have to wait for my CoolSculpting lawsuit to settle? Here at our law firm, we are committed to getting you the compensation that you are owed as quickly as possible. In general, we can settle our cases within six to eight months. However, some cases can take about two years to settle – especially if there are complications along the way. You can trust that our team is ready to get you the settlement that you are owed.

If you have further questions about the compensation that you could be eligible to receive, contact us today. Our lawyers are ready to fight for the highest recovery available for your claim.
