Generation Brand Issues Recalls Glass Light Fixtures due to Injury Risk

On June 4, 2019, Generation Brands – Tech Lighting – issued a recall for their glass pendant fixtures which were found to be defective. The recall (number 19-131) makes it clear that the glass pendant fixtures can detach from electrical cords, causing the glass fixture to fall. A falling light fixture poses a significant risk of injury, especially considering that it could impact anyone who is standing beneath the fixture, for example. The recall has affected approximately 1,200 units of the glass light fixture, including the following item numbers and UPC numbers:

Generation Brand Issues Recalls Glass Light Fixtures due to Injury Risk
The defective light fixtures were sold at independent lighting retailers around the U.S., Lightology, Circa Lighting, Lumens, Y Lighting, Wayfair, and online through build.com. The pendant glass light fixtures were sold at prices between $385 and $522 from January 2013 to December 2018.

There has only been one report of a fixture detaching and falling on someone. No serious injuries have been reported. However, it is possible that there are many unreported incidents and injuries. The recall recommends that consumers with the defective fixtures to take action to prevent others from being under the fixture (walking or standing, for example); the recall also recommends that consumers contact the company for a free repair kit and an expert installation (which will be eligible for reimbursement).

Should you follow the recommendations set by the recall? You should only the recall’s recommendations if the defective product did not result in any damages. Did you suffer damages? Did you sustain injuries due to the falling light fixture? Did a member of your family suffer injuries due to the defective light fixture? If you or your family were harmed in any way by the defective light fixtures or any other defective product, it is important that you seek legal assistance instead of following the recommendations established by the recall.

Why do you need legal assistance? All companies have to ensure that their products are safe for consumers before making them available for purchase. How Could a Defective Light Fixture Harm You and Your Family?A falling light fixture might not seem like a big deal; however, a falling light fixture can cause significant harm. Some common injuries might include head injuries (concussions), brain damage, fractures, lacerations, bruises, and scratches, for example. For most healthy adults, a falling fixture might only cause minor injuries. However, for children and the elderly, for example, a falling fixture could cause severe and even fatal injuries. Besides injuries and death, victims and their families could also result in loss of income and expensive medical bills, for example. Without a doubt a defective light fixture could have a devastating effect on victims and their families. You Have the Right to File a Defective Product Claim

Do you have the right to file a product liability claim after being affected by a defective product? Your right to pursue a claim after being harmed by a defective product depends on whether you can establish that the harm that you suffered was caused by negligence. Was the defect present in the product’s labeling, design, or manufacturing? If so, negligence might have attributed to the harm that you suffered.

To understand your right to file a product liability claim, you must understand the role that negligence will have on your claim. All companies have a specific duty of care to their consumers. They must ensure that their products are always safe for consumer use. They must subject their products to inspections and tests to identify any potential hazards that could pose a threat of injury to consumers. When companies, such as Generation Brand, fail to identify and address the hazards present in their products, they are recklessly and negligently putting their consumers at risk of suffering accidents.

Do you have the right to pursue a defective product claim? If the harm that you and your family suffered was caused by the negligent actions of a company, you could pursue a claim. You Could Sue and Recover Compensation

As explained above, you have the right to sue after being harmed by a defective product. If your claim reaches successful outcome, you could recover compensation. Your right to recover compensation depends on the specific details of your claim. How much compensation could you receive? What type of compensation could you recover? In general, the victims of defective products could receive compensation for medical expenses, lost wages, pain/suffering (mental/emotional distress), property damage, loss of consortium, funeral/burial costs, and punitive damages, for example. If you are ready to learn more about your right to receive compensation after reaching a positive claim outcome, do not hesitate to contact our law firm at your earliest convenience. The Time You Have to File Your Claim

You want to pursue a claim. Are you aware of the possibility of losing your right to file a claim simply because you failed to file your claim within the appropriate length of time? All claims are subject to a statute of limitations. A statute of limitations establishes the specific length of time that claimants have to take action and pursue their claims. Product liability claims are no different than any other claims. In the state of California, defective product claims are subject to a two-year statute of limitations. Therefore, victims affected by defective products only have two years to file their claims. If they do not file their claims on time, they will lose their right to sue – and they will lose the right to receive compensation. If you do not want to risk the possibility of losing your right to sue, it is essential that you seek guidance from the lawyers at our law firm as soon as possible.
